Terms and Conditions

1. General Terms of Sale
These general contractual terms (hereinafter referred to as the “General Terms”) govern the offering of products by Masseria Piccirillo di Palumbo Giovanna (hereinafter also referred to as the “Company”) on the website shop.masseriapiccirillo.it (hereinafter also referred to as the “Site”).
The General Terms must be accepted by users upon registration to the Site in order to take advantage of the offers provided and to proceed with purchasing products.
The Company reserves the right to amend these General Terms, in whole or in part, at any time by notifying users via the Site with at least 30 days’ notice if the terms of use for the products and services are changed.
Users are therefore required to periodically consult this page to remain informed about the applicable conditions.
It is understood that use of the Site after such changes implies tacit acceptance of them.

2. Ownership of the Site
The Site is owned by Masseria Piccirillo Azienda Agricola, headquartered in Caiazzo (Caserta), IT 81013, at Via Carpinito No. 4, VAT/C.F. 02547640611.
The products on the Site are sold directly by the Company. Products may be sold either through a permanent catalogue or via “flash-deals”, which are time- and/or quantity-limited promotions.
The product offerings include categories such as food, alcoholic beverages, and accessories (wines, sparkling wines, rum, grappa, other spirits, coffee, packaged goods such as sauces, honey, canned meats, and other food products, along with accessories for the preparation, consumption, or storage of food).
Following a completed transaction, the Company will issue the User an order confirmation.

3. Site Registration
The Site is intended exclusively for Users who are 18 years of age or older.
Browsing the Site is free, but access to sales services requires registration.
Registration is free of charge. Registered Users must provide certain personal data and complete all steps of the process (hereinafter “Registration”).
Upon registration, the User must provide an email address and choose a password, which the User agrees not to share, even temporarily, with third parties and to store with due care, diligence, and confidentiality. These credentials are the only means for identifying the User and validating access to the offers.
The User acknowledges that any actions taken using these credentials will be attributed to them and will be binding.
The User must immediately notify the Company of any unauthorized use or misuse of their login credentials or report any security breaches by third parties. Should the Company detect any violations, it may block access, delete stored information, or deny the creation of new accounts by the same User.
At any time, the User may update, modify, or request deletion of the information provided during registration. In the event of such a request, the Company may temporarily retain all or part of the data for the sole purpose of fulfilling purchases and/or completing accounting and tax procedures.
Registration is necessary to purchase products and to access summary information about the User’s activity on the Site (also referred to as the “Account”).

4. Offer Conditions
The object of the Company’s offers is the purchase of goods at the prices indicated on the Site at shop.masseriapiccirillo.it.
The Company reserves the right not to process orders from individuals who are not considered “consumers” according to its commercial policy.
In any case, the Company does not sell alcohol to persons under the age of 18.
By submitting an order, the consumer guarantees that both the buyer and, if different, the recipient of the goods are at least 18 years old.
Prices are in Euros and include VAT. Shipping costs may be fixed or variable, calculated based on the weight, number of selected items, and/or delivery address.
Shipping may be included in the price of certain items or may be free if the total order exceeds a specific value and/or product quantity threshold.
In all cases, the User will be informed of shipping costs before completing the purchase.
Product images and descriptions may not exactly match actual characteristics (e.g., in color, size, or included accessories).
All support materials are to be considered general informative content and not specific to any one offer.
Offer validity may be subject to time or quantity limits, after which availability cannot be guaranteed.
Validity dates and/or available quantities are displayed on the Site for the User’s awareness.
The Company may change offer durations or quantities at any time but will honor orders placed during the valid period.
An offer may be published multiple times. In some cases, product availability may run out after purchase: if so, the Company will issue a refund where applicable.
For some products, specific variants may not be guaranteed. In such cases, the User may express preferences during purchase but acknowledges they may receive a different variant.

5. Order Procedure and Payment Methods
Each submitted order represents an offer to purchase. Orders are subject to availability and discretionary acceptance by the Company.
Once aware of the offer conditions, the User may complete an order through the Site process.
Before finalizing the order, a summary is displayed showing unit price and total (in case of multiple items).
Shipping costs may be fixed or variable, calculated based on item weight, quantity, and delivery address.
Shipping may be included or free based on order value or item quantity.
The User will always be informed of shipping costs before completing the order.
As the final step, the User must verify and possibly modify order details, then proceed with payment.
Payment must always be made to Masseria Piccirillo Azienda Agricola, and the Company does not sell through third parties.
The order is completed upon confirmation and is subject to payment of the product price, taxes, and any applicable shipping and transaction fees.
Accepted payment methods (unless otherwise specified or agreed) include: Credit Card (Visa, MasterCard, American Express, Diners), PayPal, Bank Transfer, and Cash on Delivery.
Upon order completion, the User receives an email with all order details.
This summary email does not constitute acceptance of the order. It includes shipping and billing addresses.
Product availability may run out after purchase; in such cases, the Company will refund the User if applicable.
Charges are made upon payment confirmation unless otherwise stated in the offer terms.
For bank transfers, the email will include IBAN, amount, and order number. Payment via bank transfer must be made within the indicated timeframe and no later than 10 days from the summary email. Otherwise, the Company may not fulfill the order and will refund any payments received late, free of charge.
Upon successful payment, the Company will ship the goods via courier.
If the User realizes that they provided incorrect or incomplete information (personal or shipping), they must notify the Company promptly by emailing masseria.piccirillo@virgilio.it.
The User is solely responsible for errors or omissions in personal or shipping data, and may lose the payment if the goods are delivered to the wrong person.

6. Transaction Security
Masseria Piccirillo does not handle or store payment data (e.g., credit card numbers), which are managed and/or stored by the respective payment service providers.
Payment is processed via protected and encrypted data-entry fields. Once the transaction is complete, the service provider notifies the Company of the payment outcome, without sharing sensitive information.
For this reason, the Company has no control over or responsibility for any rejection of the User’s credit card.
The Company is not liable for any direct or indirect consequences arising from the use of credit cards by Users to pay for products or services.

7. Shipping and Delivery
Unless otherwise specified on the product page, shipping occurs within 10 working days from confirmed full payment.
If the goods become unavailable after the order is placed, any payments received will be refunded at no cost to the User.
The User may receive an email notification once the product is shipped.
If available, the courier name and tracking number will be provided to track delivery status.
The Company cannot guarantee specific delivery dates or times, as these depend on the courier, delivery address, and assigned delivery personnel.
The Company is not liable for direct or indirect consequences related to delivery times.
Unless otherwise specified, delivery is made to street level.
All bottles are shipped using suitable, courier-approved packaging designed to ensure product integrity.

8. Right of Withdrawal

A User purchasing a service for purposes unrelated to their professional activity has the right to withdraw from the purchase agreement concluded with the company without any penalty and without having to provide any reason, within 14 working days pursuant to Article 52(1) of the Italian Consumer Code, starting from the day the purchased product is received.

The withdrawal may be exercised by the Customer, pursuant to Article 54(1) of the Consumer Code, using the withdrawal form referred to in Annex I, Part B of the Consumer Code, or by submitting any other explicit statement of their decision to withdraw from the contract. This must be sent by registered mail with return receipt to:
Masseria Piccirillo, via Carpinito 4, 81013 Caiazzo (CE), Italy.

The registered letter must include the product details and the order number. The burden of proof regarding the correct exercise of the right of withdrawal, in accordance with the above procedure, lies with the User.

Upon valid exercise of the withdrawal right, the User must return the goods without undue delay and in any case within 14 days from the date they communicated their decision to withdraw from the contract, as per Article 54(4) of the Consumer Code.

The User must visibly attach to the packaging the document received from the company following the withdrawal communication, which already contains the return address and order details required to identify the returned item. It is also recommended to include a copy of this document inside the package to prevent misplacement or issues identifying the return upon arrival at the warehouse.

Shipping costs for returning the goods are borne by the User, unless the company failed to inform them otherwise at the time the contract was concluded, in accordance with Article 57(1) of the Consumer Code.

The company reserves the right to verify that the returned product—of which the User is solely responsible under Article 57(2) of the Consumer Code—is in the same condition as when delivered, i.e., that it has not been altered in its essential or qualitative characteristics and retains its original packaging and label. If not available, the User must return the item properly packaged to preserve its integrity.

The company may refuse to accept returns of food products that have been even partially consumed.

Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply to custom-made or personalized goods, or goods that by their nature cannot be returned or are liable to deteriorate or expire rapidly.


9. Refunds

If a refund is due, the company will proceed in accordance with Article 56(1) of the Consumer Code, as promptly as possible and in any case no later than 14 days from the date on which the event giving rise to the refund occurred—or, in the case of withdrawal, from the date it became aware of the User’s decision to withdraw.

Refunds will be issued using the same payment method the User used for the original transaction, unless otherwise expressly agreed with the User and provided that no additional cost is incurred as a result of the different payment method.

The company is not obliged to refund delivery costs if the User explicitly chose a more expensive delivery option than the one offered by the company. It is understood that the company may withhold the refund until the goods are received.


10. Liability of Masseria Piccirillo di Palumbo Giovanna

The company shall not be liable for any damages resulting from use of the website, such as computer viruses, errors, service interruptions, or software malfunctions—including to the User’s own equipment—that prevent or delay service provision due to external causes, force majeure, or third parties beyond the company’s control.

The company is only liable for proven defects or nonconformities in the products sold. In any case, it shall not be held responsible for delays, defects, or nonconformities due to events beyond its reasonable control, such as (but not limited to):

(i) force majeure events;
(ii) third-party issues, such as telecom or power service interruptions, or actions/omissions by couriers or shippers.


11. Dispute Resolution Procedure. Governing Law and Jurisdiction

These General Terms and Conditions are governed in every respect by Italian law. For any dispute concerning the interpretation, performance, and/or termination of the contract between the User and the company, the parties may opt for a conciliation procedure.

The conciliation procedure shall be carried out in accordance with Article 49(1)(v) of Legislative Decree No. 206 of 6 September 2005 (Consumer Code).

If the conciliation procedure fails, or if neither party initiates such a procedure, either party may refer the dispute to the judicial authorities. In such cases, the parties agree that the competent court shall be that of the User’s place of residence or domicile, if the User qualifies as a consumer under applicable law.

If the User is a professional, the Court of Caserta shall have jurisdiction.
